Terms of Service
These terms are the agreement between you and Ommelo for use of the service. By creating an account or using Ommelo, you agree to them.
Effective 31 July 2026
Acceptance and eligibility
By creating an account, signing in, or using Ommelo, you agree to these Terms and to our Privacy Policy. You must be at least 16 years old, or the age of majority where you live if higher, and be able to enter a binding contract. If you use Ommelo on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms.
Your account
Sign-in is by Google or an email magic link — there is no password to manage. You are responsible for the security of the email account and Google account you use to sign in, and for all activity under your Ommelo account. Tell us promptly if you believe your account has been accessed without your authorisation.
The service, and what it is not
Ommelo produces AI-assisted UX audits: scored reports and findings about digital interfaces you submit. The findings — including any accessibility or regulatory-compliance checks — are informational and are a starting point for your own review. They are not legal, professional, accessibility-certification, or compliance advice, and are not a guarantee that a design meets any standard or law. You remain responsible for decisions you make based on them.
Authorisation to audit and record
Ommelo lets you audit third-party sites and, with the extension, record real sessions. You warrant that you own the target of any audit or recording, or are otherwise authorised to audit it and to record the session, and that you have any consents required to capture the content you submit. For that content you act as the data controller and Ommelo acts as your processor. These obligations are set out in full in our Acceptable Use Policy, which forms part of these Terms.
Plans, payment, and cancellation
Paid plans are billed through Lemon Squeezy, which acts as the merchant of record for your purchase; your payment is subject to Lemon Squeezy's terms as well as ours, and we do not receive or store your card number. Subscriptions are billed in advance on a recurring monthly or annual cycle and renew automatically until cancelled. You can cancel at any time; cancellation stops the next renewal and your plan remains active until the end of the current paid period. Plans carry the limits described on our pricing page. We may change prices on renewal with reasonable notice.
Refunds
Where you are entitled to a refund or remedy under a mandatory consumer law — including the Australian Consumer Law and EU/UK consumer protections — those rights are not excluded or limited by these Terms and prevail over anything inconsistent here. Outside those mandatory rights, subscription fees are generally non-refundable for a period already started. Refund requests are handled together with Lemon Squeezy as merchant of record; contact us and we will help.
Intellectual property
You keep ownership of the content you submit (your audit inputs and recordings) and of the reports Ommelo generates for you. You grant Ommelo the licence needed to host and process that content and to run the audit — including sending it to our AI subprocessor — so we can provide the service. Ommelo owns the platform, the audit ruleset, scoring logic, and everything we make available to you, and grants you a limited, non-exclusive, non-transferable licence to use the service under these Terms. You may use your reports freely, including with your clients.
Acceptable use
Your use of Ommelo must comply with our Acceptable Use Policy. In short: do not audit or record sites or sessions you are not authorised to; do not capture others' personal data unlawfully; do not use Ommelo to attack, overload, or scrape sites against their terms; and do not reverse engineer, resell, or abuse the service. We may suspend or terminate accounts that violate it.
Disclaimer of warranties
To the extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that findings are error-free or complete, or that the service will be uninterrupted. Nothing in this section limits guarantees that cannot be excluded under applicable consumer law.
Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special, or consequential loss, or for lost profits or data, arising from the service. Where liability cannot be excluded but can be limited, and to the extent permitted by law, Ommelo's total liability arising out of or relating to these Terms is limited to the fees you paid to Ommelo in the twelve months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law, including under the Australian Consumer Law.
Indemnity
You will indemnify Ommelo against claims, losses, and costs arising from content you submit or sessions you record without authorisation, from your breach of these Terms or the Acceptable Use Policy, or from your unlawful use of the service — except to the extent the claim results from Ommelo's own breach or negligence.
Data processing for business customers
Where you use Ommelo to process personal data on behalf of an organisation, our Data Processing Agreement applies and forms part of these Terms for that use.
Termination
You can stop using Ommelo and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or the Acceptable Use Policy, or where we must to comply with law. On termination your licence to use the service ends; you can export or delete your content, and account deletion hard-deletes your associated data as described in the Privacy Policy.
Changes to these terms
We may update these Terms as the service changes. When we make a material change we will update the effective date above and, where appropriate, notify you. Continuing to use Ommelo after a change takes effect means you accept the updated Terms.
Governing law and disputes
These Terms are governed by the laws of Australia, and the courts of Australia have jurisdiction — without depriving you of the protection of mandatory consumer laws of the country you live in. We would rather resolve any issue directly, so please contact us first and we will try to sort it out.
